Returns and exchanges are subject to Resolution of the Government of the Republic of Lithuania No 697 of 11 June 2001 “On the Approval of Retail Trade Rules” .
When the Buyer of the KML Tading MB online store http://www.greenworksbaltic.com is a consumer as defined in Article 6.2281 of the Civil Code of the Republic of Lithuania, Article 6.2281 of Civil Code of Republic of Lithuania, he/she has the right to withdraw from the contract of sale and to return the received (withdrawn) Goods within a period of fourteen (14) days, without stating any reason. This provision means that the Buyer, having changed his mind or decided to withdraw from the Goods for other reasons during the aforementioned period, shall be entitled to notify the Seller of his request to return the Goods to the Seller and to receive a refund, provided that the Goods have not been used, damaged or substantially altered in appearance, that is to say, only such changes have been made to the appearance of the Goods or to the appearance of the packaging thereof as are necessary for the examination of the Goods received. Except for the exceptions provided for in Article 6.22810(2) of the Civil Code of the Republic of Lithuania where this right of cancellation shall not apply to the Buyer. The costs of returning the Goods shall be payed by the Buyer.
The right of the Buyer to return quality goods purchased in an online shop does not apply to Contracts for:
- Goods made to the Buyer’s specific instructions, which are not pre-manufactured and which are made in accordance with the Buyer’s personal choice or instruction, or Goods which are expressly tailored to the Buyer’s personal needs;
- Perishable Goods or Goods with a short shelf life;
- Packaged Goods that have been unpacked after delivery and are unsuitable for return for health or hygiene reasons;
- goods which, by their nature, do not become indistinguishable from other goods after delivery;
- packaged video or audio recordings or packaged software that have been unpacked after delivery;
- any exceptions provided for when this right of termination is not applicable to the Buyer are set out in Article 6.22810 (2) of the Civil Code of the Republic of Lithuania.
The right to withdraw from a distance contract within 14 (fourteen) days without giving a reason does not apply to legal persons (entrepreneurs).
In the event of the Buyer exercising his right to withdraw from the Contract of Sale, the following conditions for the return of the Goods shall apply:
- If the Buyer wishes to return the Goods and cancel the Contract, the Buyer must send to the Seller a completed “Request for Replacement or Return of Goods” form setting out the decision to cancel the Contract.
- If you wish to request the return of an item, you can do so by filling in the relevant form on http://www.greenworksbaltic.com or by emailing onfo@kml-trading.com.
- When returning the Goods, you must provide a VAT invoice or other proof of purchase and the order number of the Goods.
- The Buyer shall return or hand over the Goods to the Seller or to a person authorised by the Seller to receive the Goods without delay and not later than 14 (fourteen) days from the date of delivery of the Goods.
- Goods shall be returned upon dispatch at the Buyer’s expense.
- The returned product must be complete, unused, undamaged, unsoiled, in the original manufacturer’s original packaging, in good condition, undamaged, unsoiled, and in good condition, with the original labelling intact (labels, protective films, etc. intact). All returned goods must be accompanied by the original labels, protective bags and the same accessories as they were sold with. If the product is not complete, used, damaged, soiled, in non-original manufacturer’s packaging or in damaged, soiled packaging, has lost its original appearance, or has damaged the original labelling, it will not be accepted for return. Gifts received in exchange for the Goods, if any, must also be returned.
- The Buyer shall be liable for any diminution in the value of the Goods (including, but not limited to, the cases set out above) caused by actions not necessary to determine the nature, characteristics and performance of the Goods. That is to say, the Seller shall have the right not to accept the Goods for return or to unilaterally reduce the amount of the refund to the Buyer in proportion to the aforementioned diminution in value of the Goods.
- The Buyer shall be fully responsible for the Goods until they are returned to the Seller.
- The Buyer shall bear the direct costs of returning the Goods, unless the Seller bears these costs in accordance with the contract.
- Upon receipt of the returned Goods and having assessed their quality, the Seller shall, within 30 days of the return of the Goods, refund to the Buyer the price of the Goods less delivery costs, except for the exceptions provided for in Clause 6, or the unsuitable Goods may be replaced with suitable Goods (subject to a refund of the difference in price). In the event that the purchase was made with an online card, the funds will be refunded to the same card. If only part of the Goods are returned, the delivery costs will not be refunded.
- In the normal course of business, the Seller shall transfer the refunded amounts to the bank account specified by the Buyer in any bank operating in the Republic of Lithuania.
- The Seller shall have the right not to refund the Buyer until the Goods have been returned to the Seller and inspected for compliance with the relevant clauses of the Regulations.
- If we have delivered the wrong product, we will pay the cost of returning it and sending you a new one.
ORDERING A PRODUCT BASED ON A SAMPLE (PRODUCT DESCRIPTION, CATALOGUES, MODELS, ETC.)
Not all Goods listed in the online shop are available. In case KML Trading MB does not have the Goods ordered in the catalogue of the online store http://www.greenworksbaltic.com in its warehouses, but the Buyer wishes to purchase the Goods from the catalogue – the contract shall be concluded in accordance with the provisions of Article 6.356 of the Civil Code of the Republic of Lithuania and the Buyer, wishing to withdraw from the contract or to return the Goods of high quality, shall be obliged to reimburse the Seller for the necessary costs incurred by the Seller in the performance of the contract.
When ordering an item, the Seller may request payment for the goods by prepayment.
RETURNING/EXCHANGING FAULTY OR INCOMPLETE GOODS
If you wish to complain about defective or incomplete goods, you can do so by emailing info@greenworks.lt
When complaining about defective or incomplete goods, the Buyer must provide the following information:
- the VAT invoice or other proof of purchase and the order number of the Product;
- Identify any defect, fault or incomplete part of the Goods;
- Pictures of the defective or incomplete product, clearly showing the defects;
- Pictures of the original packaging of the product from all sides (the product code must be visible);
- If the item was delivered by courier, photos of the parcel packaging from all sides (the parcel number must be visible);
- A completed and signed “Request for replacement or return” form.
When making a complaint, the buyer must specify how he wishes the complaint to be resolved:
- You are asked to replace the returned product with a quality product;
- Incomplete The product is requested to be replenished with the missing parts;
- Apply a discount to a defective or incomplete Product, i.e. reduce the price of the Product;
- Refund the money paid for the Goods.
A return sticker will be sent to you once your return has been confirmed. Please place the completed „Request for Replacement or Refund“ form in the parcel/box with the returned item. Place the return sticker on the parcel.
Upon receipt of the returned goods, we will replace the faulty item with a quality item of your choice, apply a discount to the faulty item or refund the full amount paid for the item. We will cover the cost of returning the item and the cost of sending the new item.
The Buyer is responsible for the goods until they are returned to the Seller.
DAMAGED SHIPMENT
When you pick up your order at the showroom, please check the condition and equipment of the goods and sign the invoice.
When you receive your parcel, check the quality of the parcel in the presence of the courier. If you notice any damage to the packaging and/or goods, or inconsistencies in the product:
- Notify the courier who delivered the parcel immediately;
- On the delivery note, please note that the packaging is damaged and fill in the packaging damage/non-compliance certificate with the courier;
- Check the goods inside the packaging and note any damage on the report;
- Take photos of the damage. The photos will be needed for the return procedure;
- If the packaging is intact, there is no need to check the goods in the presence of the courier.
Upon acceptance of the ordered goods and signing the delivery document without comments, the delivery is deemed to have been made in good order and we accept no liability for:
- damage to the goods, unless such damage is due to a manufacturing defect;
- discrepancies in the composition of the goods, provided that these discrepancies can be detected on external inspection of the goods.

The provision of personal data is necessary for the conclusion and performance of the contract to which the Buyer is a party. In the absence of such data, KML Trading, MB will not be able to conclude and perform the contract.
The Buyer has the right to request access to his/her personal data, to have them corrected, to have them deleted in the cases provided for by law, to restrict the processing of the data.The Buyer can exercise these rights by contacting info@kml-trading.com. The Customer also has the right to lodge a complaint with a supervisory authority, in particular in the EU Member State in which he/she has his/her habitual residence, place of work or the place where the suspected infringement took place. In the Republic of Lithuania, the supervisory authority is the State Data Protection Inspectorate.
